Welcome to our website. If you continue to browse and use this website, or book a session with us, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you.
The term "the Photographer", "us", or "we" refers to the owner of the website and photography business, Luxe Paws Photography. The term "you" or "the Client" refers to the user or viewer of our website or the purchaser of our services.
1. Cancellation & Rescheduling
Client Rescheduling: We require at least 7 days' notice to reschedule a session for any reason. Your booking fee may be transferred once to a new date. If you cancel without rescheduling, your booking fee is forfeited.
Weather & Safety: As dog photography often takes place outdoors, the Photographer reserves the right to reschedule the session in the event of poor weather (e.g., heavy rain, extreme heat, or storms) to ensure the safety and comfort of the dogs and participants.
Photographer Cancellation: In the unlikely event that the Photographer must cancel due to illness, emergency, or circumstances beyond their control, all monies paid by you will be refunded in full, or the session will be rescheduled at your choice.
2. Dog Safety, Behaviour & Liability
Welfare & Control: The Client is solely responsible for their dog’s welfare, needs (including providing water and food), and behaviour throughout the session. Dogs must be kept on a lead unless in a safe, designated area expressly agreed upon by the Photographer.
Disclosures: The Client must inform the Photographer of any behavioural issues, anxieties, or health conditions regarding the dog prior to the session.
Session Termination: The Photographer reserves the right to terminate the session immediately if they feel the dog, the Photographer, or any other person is at risk of harm. No refunds will be given in this scenario.
Damages: The Client is solely responsible and financially liable for any damage or injury caused by their pet(s) to the Photographer’s property, equipment, or to any third parties during the session.
3. Image Delivery & Viewing
Proofing Gallery: A private online viewing gallery will be provided within 14 days of your session.
Purchases: Following the delivery of the gallery, digital images can be purchased for an additional fee. Final edited images will be delivered only after image selection and full payment have been processed.
Unedited Files: Raw, unedited files are not useful for general viewing and will not be provided to the Client under any circumstances.
4. Copyright, Usage & Model Release
Copyright Ownership: The Photographer retains the sole copyright of all images taken during the session.
Client Usage (Personal License): The Client is granted a non-exclusive license for personal use only (e.g., sharing on personal social media, personal printing for home display).
Restrictions: The Client may NOT, without the Photographer's prior written consent:
Sell, license, or transfer the images to any third party.
Use the images for any commercial purpose, including advertising, marketing, or product promotion.
Submit images to stock libraries or photography competitions.
Alter, crop, filter, or edit the images in a way that materially changes their appearance.
Remove or obscure any watermark, metadata, or copyright notice.
Model Release: The Client grants the Photographer permission to use the images for marketing, social media, website portfolios, and promotional purposes unless the Client explicitly opts out in writing prior to the session.
5. Limitation of Liability
Financial Limit: The Photographer’s entire liability for any claim, loss, damage, or injury arising under this Agreement—whether in contract, tort, or otherwise—shall be strictly limited to a refund of the total fees paid by the Client.
Technical Failure: In the event of catastrophic equipment failure, data loss, or theft, the Photographer’s liability is limited to a refund of payments related to the specific services or products affected. The Photographer is not responsible for the loss of photos due to factors beyond their reasonable control (e.g., sudden technical failure of digital storage media).
6. Data Protection & Privacy
Your privacy is important to us. Personal data provided by the Client will be processed securely and in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Data is collected strictly for the purposes of administering your booking, delivering your products, and marketing (only where explicit consent has been given). For full details, please view our Privacy Policy.
7. General Website Use
The content of the pages of this website is for your general information and use only. It is subject to change without notice.
Unauthorised use of this website or the images displayed on it may give rise to a claim for damages and/or be a criminal offence.
8. Governing Law
These Terms and Conditions, and any dispute arising out of them, are governed by and construed in accordance with the laws of England and Wales.
